California Attorney General Fines Subprime Lender for Harassment

Here at Auto Credit Express, we like to think that most large subprime auto lenders, especially the national ones, will, given the current economic climate, try and work with their customers who are currently having issues with their subprime car loans.

But, as in every business, there are always a few individuals (or companies) that cast a bad light on the entire industry. Such is the case with Lobel Financial, a subprime auto lender based in California. This week, the California Attorney General’s office announced that the state had fined the lender $250,000 in penalties and fees for an “illegal campaign of harassment and intimidation” against its customers that were behind in their payments.

San Diego – Attorney General Edmund G. Brown Jr. today forced Lobel Financial, a sub-prime auto lender, to stop its “illegal campaign of harassment and intimidation” against borrowers behind in their bills.

“This company charged its customers exorbitant interest rates for car loans and then waged an illegal campaign of harassment and intimidation when they couldn’t pay up,” Attorney General Brown said. “Now Lobel must stop its abusive tactics and comply with the law.”

Lobel Financial is headquartered in Anaheim, Calif. but makes loans to customers in Los Angeles, San Diego, Sacramento, the Bay Area, the Central Valley, and other areas of the state.

Lobel provides financing to people with poor credit who purchase vehicles through used-car dealerships. The typical interest rate of their loans is between 21-23 percent. Lobel performed its own debt collection efforts when consumers failed to make the required payments.

In 2007, the California Attorney General’s Office initiated an investigation into Lobel’s debt collection practices. The investigation found that Lobel frequently violated California’s Fair Debt Collection Act by:

- Calling its customers repeatedly and allowing the phone to ring continuously;
- Calling a customer’s employer and family members; and
- Using a false name when calling.

Additionally, the company used more sophisticated “pre-texting” tactics to obtain confidential information of their customers.

For instance, Lobel deceived ATT Wireless into providing confidential telecommunications records of at least 190 California ATT customers.

Lobel also used a calling card scam to con consumers into providing their calling information. Lobel had a third-party vendor send the customer a “free” phone card; the company would then obtain information about the calls made by the customer using the calling card.

Hundreds of California consumers across the State were victimized by Lobel’s constant harassment and illegal debt collection activities.

Lobel Financial will pay $150,000 in civil penalties and $100,000 to the State for attorneys’ fees and costs.

The Bottom Line

Here at Auto Credit Express, we applaud the actions of the California Attorney General. Given the current economic crisis, it should be the job of banks and other lenders to work with their customers, as much as possible, within a climate of mutual cooperation so that both lender and customer win out in the end.

    Credit one is the lender/finance company I used to purchase a vehicle through. I have been three months behind on payments; I agreed to work something out. I was unable to, and told Oscar Mejia, my account rep I would give up the car, to pick it up from my home address by email. My husband received a call from their Legal Department three times between 7:32-7:34 am on 4/24/09; they have called him several times at work. Glenn and Sorita Waller (parents) have received numerous calls, even though they told Oscar not to call, because our relationship is strained due to Oscar’s rude/harassing everyday contact with them. I told Oscar to pick the car up by phone and email on 4/24/09. 4/25/09 I got a call from his supervisor stating they were aware of this, and what do I want to do. 4:58pm-on 4/25, Oscar left a vim stating they were coming after me and this would never end!4/25/09 at 8:07 pm. Oscar called me from (714) 916-3612 and told me they would not take the car back, they wanted their money, and I better go out and get it or something will happen! I told him I have been unemployed and unable to, he told me to grow up and borrow it, I told him no one I knew would be able to help me they are in bad situations like me, and I told him I had to pay my rent, because I almost was evicted. He told me I better get him some money or he was sending someone after me. I asked him what did that mean, he was sending someone to kill me, and he said you said it! Not me! You will find out! He told me you better go get a job right now! I told him it was late, and he cannot call me past 8 pm, it is against the law, he told me I don’t know anything about the law, when it comes to his money I better get it. I told him I am not into killing or selling drugs, I can’t get a job at night. I yelled obscenities at him; he told me you better get the money. I don’t understand Credit One gave me the money for a car, they don’t want the car, and they want the money. I told him, I don’t have it and I wasn’t lying. I told him I told him to pick the car up yesterday, he said we want the money and you better get it, and he hung up on me. Earlier in the week someone came to my door, and I watched through the peephole as they pounded the door with hands and feet! I was afraid to answer the door. They left a note from Credit One. I am really afraid, several times a day Oscar calls and leaves rude, harassing messages to myself, and my family members. I tried to make my payments, I have been unemployed and unable to, and they can get the car. I am really afraid to talk to anyone from that company anymore. Oscar Mejia always insinuates that something is going to happen to me, that things are going to get worse for me with dealing with Credit One, and they are sending someone to get me. Please help me. I have saved over 19 messages from him. I have some documentation as well

    We are not attorneys and we don’t give legal advice, but this certainly sounds like harrassment to us. At this point in time we suggest that you should contact your local police and see what they have to say about it.
